Incoming mail from the court, an attorney, the secretary of the South Dakota Department of Corrections, the Governor, or legal services must be opened in the presence of the inmate recipient and not read; however, department officials may take steps to determine the genuineness of the addressor as represented on any envelope. The envelope must be clearly marked "privileged."
