The secretary may issue permanent permits for all apiaries which are located three miles or more from any other beekeepers' approved permanent locations. The secretary may issue permanent permits to beekeepers to allow placement of apiaries closer than three miles to each other upon consideration of factors as they relate to pest control. Such factors may include density of bees, location and vegetation, landowner needs, disease history and management practices, and other relevant information. The beekeeper applying for a location less than three miles from another beekeeper's location and the beekeeper whose location is within three miles of the location applied for may be required to provide information for the secretary's consideration.
