If testing reveals milk to be positive for drug residues, the milk shall be disposed of in a manner that removes it from the human food chain. The milk buyer shall determine the producer or producers responsible for the violation and immediately notify the secretary.

The secretary shall immediately suspend the manufacturing permit of the producer responsible for drug residues. The penalty shall be for the value of all milk on the contaminated load plus any costs associated with the disposition of the contaminated load. The secretary shall accept certification from the violative producer's milk buyer as satisfying the penalty requirements. This certification shall be sent to the secretary promptly after the disposition of the contaminated load. For a third violation of drug residue in 12 months, the secretary shall hold a hearing pursuant to SDCL 1-26 to revoke the producer's permit.
