Section 61-9.503.B.10 - Applicability

(a) This part applies to any person who prepares sewage sludge that is applied to the land, to any person who applies sewage sludge to the land, to sewage sludge applied to the land, and to the land on which sewage sludge is applied.

(b) Bulk sewage sludge.

(2) The Department, may apply any or all of the general requirements in section503.12 and the management practices in section503.14 to bulk sewage sludge meeting the pollutant concentrations in section503.13(b)(3)(b)(3), the Class A pathogen requirements in section503.32(a)(a), and one of the vector attraction reduction requirements in section503.33(b)(1)(b)(1) through section503.33(b)(8)(b)(8), on a case-by-case basis after determining that the general requirements or management practices are needed to protect public health and the environment from any reasonably anticipated adverse effect that may occur from any pollutant in the bulk sewage sludge.

(2) The Department, may apply any or all of the general requirements in section503.12 or the management practices in section503.14 to derived bulk material meeting the pollutant concentrations in section503.13(b)(3)(b)(3), the Class A pathogen requirements in section503.32(a)(a), and one of the vector attraction reduction requirements in section503.33(b)(1)(b)(1) through section503.33(b)(8)(b)(8), on a case-by-case basis after determining that the general requirements or management practices are needed to protect public health and the environment from any reasonably anticipated adverse effect that may occur from any pollutant in the bulk sewage sludge.

(d) The requirements in this part may be applied by the Department, on a case-by-case basis, when a bulk material derived from sewage sludge is applied to the land if the sewage sludge from which the bulk material is derived meets the ceiling concentrations in Table 1 of section503.13 and the pollutant concentrations in Table 3 of section503.13; the Class A pathogen requirements in section503.32(a)(a); and one of the vector attraction reduction requirements in section503.33(b)(1) through (b)(8)(b)(1) through (b)(8).

(e) Sewage sludge sold or given away in a bag or other container for application to the land. The general requirements in section503.12 and the management practices in section503.14 do not apply, except for section503.12(o)(o), section503.12(p)(p), section503.12(q)(q), and section503.14(e)(e), when sewage sludge is sold or given away in a bag or other container for application to the land if the sewage sludge sold or given away in a bag or other container for application to the land meets the ceiling concentrations in Table 1 of section503.13 and the pollutant concentrations in Table 3 of section503.13; the Class A pathogen requirements in section503.32(a)(a); and one of the vector attraction reduction requirements in section503.33(b)(1) through (b)(8)(b)(1) through (b)(8).

(f) The general requirements in section503.12 and the management practices in section503.14 do not apply, except for section503.12(o)(o), section503.12(p)(p), section503.12(q)(q), and section503.14(e)(e), when a material derived from sewage sludge is sold or given away in a bag or other container for application to the land if the derived material meets the ceiling concentrations in Table 1 of section503.13 and the pollutant concentrations in Table 3 of section503.13; the Class A pathogen requirements in section503.32(a)(a); and one of the vector attraction reduction requirements in section503.33(b)(1) through (b)(8)(b)(1) through (b)(8).

(g) The requirements in this part do not apply, except for section503.14(e)(e), when a material derived from sewage sludge is sold or given away in a bag or other container for application to the land if the sewage sludge from which the material is derived meets the ceiling concentrations in Table 1 of section503.13 and the pollutant concentrations in Table 3 of section503.13; the Class A pathogen requirements in section503.32(a)(a); and one of the vector attraction reduction requirements in section503.33(b)(1) through (b)(8)(b)(1) through (b)(8).

(h) If other materials are mixed with the sewage sludge, the final product must meet the applicable requirements related to pollution limits (in section503.13), pathogen reduction (in section503.15(a)(a)), and vector attraction reduction (in section503.15(c)(c)) after the materials have been added to the sewage sludge.
