A. Any person or persons violating these regulations shall be subject to the penalties provided in Section 48-1-320 and Section 48-1-330, of the 1976 Code of Laws as amended.
B. The Department will:
(1) Investigate all
citizen complaints;
(2) Not oppose
intervention by any citizen when permissive intervention may be authorized by
statute, rule, or regulation; and
(3) Publish notice of and provide at least 30
days for public comment on any proposed settlement of a State enforcement
action. Where the violation(s) poses an imminent and/or substantial hazard to
the health of persons or to the environment, the Department may waive this
requirement.
