Section 61-79.261.A.8 - PCB wastes regulated under Toxic Substance Control Act

The disposal of PCB-containing dielectric fluid and electric equipment containing such fluid authorized for use and regulated under 40 CFR 761 and that are hazardous only because they fail the test for the Toxicity Characteristic (Hazardous Waste Codes D018 through D043 only) are exempt from regulation under parts 261 through 266, and parts 268, 270, and 124, and the notification requirements of section3010 of RCRA and the South Carolina Hazardous Waste Management Act 44-56-120.
