Section 61-4.1600.1606 - Application for Administrative Inspection Warrant

(a) An administrative inspection warrant application shall be submitted to any judge or any magistrate and shall contain the following information:
(1) The name and
address of the controlled premises to be inspected;
(2) A statement of statutory authority for
the administrative inspection warrant, and that the fact that the particular
inspection in question is designed to insure compliance with the regulations
promulgated under those acts;
(3) A
statement relating to the nature and extent of the administrative inspection,
including, where necessary, a request to seize specified items and/or to
collect samples of finished or unfinished controlled substances;
(4) A statement that the establishment
either:
(i) Has not been previously inspected,
or
(ii) Was last inspected on a
particular date.
(b) The application shall be submitted under oath to an appropriate judge or magistrate.
