Section 61-107.18.I - Violations and Penalties

A violation of this regulation or any permit, order, or standard issued pursuant to or related to this regulation subjects the person to the issuance of a Department order or to civil enforcement action in accordance with S.C. Code Section 44-96-450, as amended, which may include civil penalties in accordance with the Solid Waste Policy and Management Act (SCPMA) and any amendments thereto. Willful violation of this regulation or any permit, order, or standard issued pursuant to or related to this regulation subjects the person to the issuance of a Department order which may also include civil penalties in accordance with the SCPMA, as amended, and may also result in a criminal enforcement action in accordance with S.C. Code Section 44-96-450, as amended. Any person to whom an administrative order is issued may appeal it as a contested case pursuant to R.61-72, Procedures for Contested Cases, and the S.C. Administrative Procedures Act, S.C. Code Section 1-23-310 et seq., as amended.
