Section 61-107.14.H - Disciplinary Sanctions Allowable and Procedures for Disciplinary Action

1. Disciplinary action shall be based on the severity of the violation incurred as determined by the Department. Action shall consist of either:
a. Probation under specified conditions
relevant to the specific grounds for disciplinary action. Additional education
or training, or reexamination may be required as a condition of probation;
or,
b. Revocation of an operator's
certification for a specified timeframe as determined by the
Department.
2. The following procedure shall be followed when disciplinary action is initiated:
a. A Department written notice shall be given
to an operator against whom disciplinary action is being taken; and,
b. Within fifteen (15) days from receipt of
written notification of disciplinary action by the Department, the operator may
appeal it as a contested case pursuant to R.61-72 and the Administrative
Procedures Act.
