(a) Net family income after applicable deductions and disregards cannot exceed the following:
(1) The percentage of the Federal Poverty
Income Guidelines (FPIGs) for the appropriate family size for mandatory
coverage set forth in section 1902 of the Social Security Act (42 U.S.C.A. §
1396a).
(2) The percentage of the FPIGs for the
appropriate family size for the optional coverage established in §
140.1(b)
(relating to policy on healthy beginnings) for pregnant women and infants under
1 year of age.
(b) The unborn child is counted as a family member when determining eligibility of the pregnant woman, including her presumptive eligibility.
