Section 859-400-0200 - Standard and Burden of Proof

(1) The standard of proof at the relief hearing shall be whether petitioner has demonstrated by clear and convincing evidence that the petitioner:

(a) is statistically unlikely to reoffend; and

(b) does not pose a threat to the safety of the public.

(2) The burden of proof shall be on the petitioner.
