(1) Compensatory Mitigation. Unless otherwise approved by the Department, compensatory mitigation options are:
(a)
Mitigation bank credit purchase from a Department-approved mitigation bank with
a service area that includes the proposed removal-fill site and that meets the
eligibility requirements for CM outlined in ORS 141-085-0690;
(b) In-lieu fee credit purchase that meets
the eligibility requirements for CM outlined in ORS 141-085-0690; and
(c) Cash payment to the Department's payment
in-lieu program.
