Chapter 20 - Cemetery Merchandise Rules

Effective 7-1-10, 8 O.S., § 304 was amended and recodified to 36 O.S., § 7124, effectively transferring the authority for issuing the rules in this Chapter 20 from the Oklahoma Banking Commissioner to the Oklahoma Insurance Commissioner [Laws 2010, c. 58]. "The [Insurance] Commissioner is authorized to promulgate reasonable rules concerning . . . the orderly administration and implementation of the Cemetery Merchandise Trust Act" [Laws 2010, ch. 58, § 14(A)]. The Insurance Commissioner subsequently enacted emergency rules in Chapter 25 of its Title [OAC 365:25-23-1 thro ugh 365:25-23-9] on 10-19-10, which were later superseded by permanent rules on 7-14-11. However, as of the cutoff date for this 2011 Edition of the OAC, the Banking Commissioner had not revoked the rules in this Chapter. For more information on this transfer, see Laws 2010, c. 58.
