(a) Governmental entities may carry their own risk without insurance as provided in 85A O.S. § 107. They must apply using the same application as private employers, and submit the same required documents, with the exception of interim financial statements. Governmental entities will be exempted from posting a security deposit if they make an appropriation into a segregated workers' compensation fund. The amount of the appropriation must be at least the entity's average yearly workers' compensation losses paid for three (3) calendar or fiscal years immediately preceding the application date.

(b) Certain public trust employers will be required to post a security deposit in lieu of an appropriation. The Commission will make this determination at the time of application review.
