Section 800:1-9-6 - Administrative hearings

(a) Request. A hearing request shall be in writing and shall be filed with the Administrative Law Clerk as part of or in response to a filed Petition.

(b) Scheduling. The Department shall schedule an administrative hearing after receipt of a proper and timely request.

(c) Notice. When the Department schedules an administrative hearing, the Administrative Law Clerk shall notify the parties of the date, time and place of the hearing. Such notice shall satisfy the notice requirements of the APA and shall be made at least fifteen (15) days prior to the hearing unless otherwise provided by law or agreed by the parties.

(d) Procedure. The Administrative Law Judge may refer to District Court Rules and Procedure in the absence of applicable APA and Department statutes and rules, including this Chapter. The Administrative Law Judge, with the consent of all parties, may vary the procedures of this Chapter.
