(a) Notice preparation.
(1)
After an application has been duly filed and accepted, the Board may require that applicants for permits
involving significant and high hazard-potential dams publish notice as it instructs. If such notice is
required, a notice will be prepared by the Board and include information describing the application, the name
and address of the applicant and opportunities for public comment.
(2) The notice will be mailed to the applicant with a letter of
instructions as to the publication. Prior to publication, the applicant shall check the notice for any
errors.
(b) Publication in newspaper.
(1) The notice of application, if required, shall be published once a week
for two (2) consecutive weeks on the dates designated by the Board in a newspaper having general circulation
in the county where the dam is located.
(2) The last notice shall
be published at least ten (10) days prior to the hearing date.
(3) The applicant shall bear the cost of publication and shall see that the
notice is reproduced accurately in the newspaper.
(4) If the
Board instructs the applicant to mail notice, such mailing shall be by certified mail, return receipt
requested.
