Section 450:70-4-8.5 - Take-home doses, limits

(a) With the exception of FDA-approved buprenorphine and buprenorphine combination products for opioid use disorder, take-home doses shall be limited, in accordance with 42 CFR § 8.12. Unless requirements at 42 CFR § 8.12 state otherwise, take-home doses shall be limited as follows:
(1) Any person served
in comprehensive treatment may receive their individualized take-home doses as
ordered for days the OTP is closed for business, including one weekend day and
State and Federal holidays, regardless of length of time in
treatment.
(2) During the first
fourteen (14) days of treatment, the take-home supply (beyond that of (1) in
this subsection) is limited to seven (7) days.
(3) Beginning at fifteen (15) days of
treatment, the take-home supply (beyond that of (1) in this subsection) is
limited to fourteen (14) days.
(4)
Beginning at thirty-one (31) days of treatment, the take-home supply (beyond
that of (1) in this subsection) is limited to twenty-eight (28)
days.
(b) Compliance with 450:70-4-8.5 may be determined by:
(1) A review of policies and
procedures,
(2) Treatment records,
and
(3) Other facility
documentation.
