Section 375:25-3-22 - Action of the hearing officer when the licensee fails to appear

Any licensee who fails to appear before the hearing examiner, as directed, after having been first given proper Notice of Hearing on the Merit, proof of Service of such notice having been duly made, may be determined to have waived his or her right to present a defense to the offense alleged in the notice. A suspension, revocation or denial of the license of any such person may be ordered by the hearing examiner if it appears, after having heard the evidence, that the violation alleged did in fact occur, whether or not such licensee appears before the hearing examiner on the date of the hearing.
