Section 310:260-7-5 - Handling of nonsalvageable merchandise

(a) Nonsalvageable merchandise. Food deemed to be nonsalvageable merchandise are:
(1) Foods contaminated and/or adulterated by
pesticides or other chemicals;
(2)
Potentially hazardous foods (frozen or those requiring refrigeration) which
have been exposed to a temperature above 45° F (7.2° C) for a period
exceeding 4 hours;
(3) Foods
packaged in paper or other porous materials which have been subjected to
contamination.
(4) Those described
in Section
310:260-7-3 as
nonsalvageable.
(b) Distribution of nonsalvageable merchandise. Nonsalvageable merchandise shall not be sold or distributed as food, but shall be disposed of in a manner approved by the Department.
