Section 265:10-3-3 - Day nurseries (day care centers) and child care institutions

(a) Definitions.
(1)
"Day
nursery (day care center)" means a facility which provides care for six
or more children for six or more hours of the 24-hour day.
(2)
"Child care institution"
means a 24-hour residential group care facility with a large number of
unrelated children living together with adults other than parents. A
specialized service to be selectively and appropriately used for certain
children whose needs at the present time cannot be adequately met within the
family.
(b) Installation.
(1) Existing and
new day nurseries, whether called day care, family day care, or group day care,
must follow the provisions for smoke detection as outlined in sections 16.3.4.5
and 17.3.4.5 of the 2009 edition of the Life Safety Code, NFPA 101.
(2) Child Care Institutions shall be provided
with smoke detection as follows:
(A) New
facilities must meet the provisions of the building codes as most recently
adopted by the Oklahoma Uniform Building Code Commission.
(B) Existing facilities must meet the
appropriate provisions of the 2009 edition of the Life Safety Code based on the
size of the facility.
(C) Existing
child care institutions and day nurseries must meet the provisions of the Life
Safety Code, 2009 Edition.
