Section 260:135-3-66 - Replacement of driver license or identification card

(a) When an individual requests replacement of his or her driver license or identification card, the licensed operator shall verify the identity of the applicant and the eligibility of the individual by contacting Service Oklahoma. All replacement requests require proper identification, as required by OAC 260:135-5-10 for a driver license or OAC 260:135-5-14 for an identification card, and payment of the required fee.

(b) A replacement driver license may be issued to any individual whose driving privilege is not under suspension, revocation, disqualification, cancellation, or denial.

(c) The licensed operator shall offer the person the choice of a renewal or replacement license or card when the application is made within one (1) year of the expiration date of the license or card.

(d) A replacement driver license or identification card may be issued to any individual who requests a last name change, upon compliance with the primary and secondary identification requirements prescribed in OAC 260:135-5-3 and with OAC 260:135-5-16, or address change provided he or she pays the required fee.

(e) The licensed operator shall:

(1) for a Class D Real ID Non-compliant licensee or identification card holder, return the old license or card, if it is available, to the licensee or holder after first punching a hole through the identification number on the license or card or cutting the lower right corner; or

(2) for a Class A, B, or C commercial licensee or any Real ID Compliant licensee, the license shall be surrendered, if it is available, by the licensee to the licensed operator. The licensed operator shall retain the license and return it with the licensed operator's regular reports to Service Oklahoma.

(f) All class A, B, and C replacement licenses require a clearance from the Driver License Examiner.
