Section 150:65-5-1 - Eligibility

(a) Eligible entities which may apply for the Former Military Facility Development Program are establishments that meet the qualifications of 68 O.S. Supp. 1994, Section 3601 et seq. and 150:65-1-1 through 150:65-1-13 except that the establishment:

(1) Has an annual gross payroll for new direct jobs projected to equal at least One Million Five Hundred Thousand Dollars ($1,500,000.00) but less than Two Million Five Hundred Thousand Dollars ($2,500,000.00) within three (3) years of the anticipated date of receipt of the first incentive payment; and

(2) Locates its principal business activity at a former military facility used primarily for a "military purpose." Provided, however, that the restrictions of 68 O.S. Supp. 1994, Section 3802 (H) shall apply.

(b) For purposes of this chapter "military purpose" shall not include the storage of prisoners or ammunition and "military facility" shall only include those facilities operated by the United States Army, Navy or Air Force.
