Section 150:45-5-3 - Corrective and remedial actions

The Department may take any or all of the following actions with regard to a substate planning district when there has been a substantiated program violation as delineated in 150:45-5-2 of these rules:

(1) Add conditions to contracts;

(2) Withhold funds;

(3) Reduce the total amount of a grant award;

(4) Require the return of unexpended funds;

(5) Require repayment of expended funds;

(6) Cancel an allocation agreement and recover all funds expended in an ineligible manner prior to the date of notice of cancellation, or

(7) Deny future program applications and proposals and program participation for a period not to exceed two (2) program years.
