Section 150:1-15-11 - Motions

Motions filed seven (7) days prior to the Show Cause hearing may be specially set for hearing. Such motions must be in writing. The hearing examiner may grant such a hearing. Unless such a hearing is set, it shall be presumed the motion shall be heard and considered at the time of the show cause hearing. Motions filed within seven (7) days of the show cause hearing shall be heard and considered at the time of the hearing. Motions entered upon the open record may be made orally or may be submitted in writing; motions entered at this time shall be orally argued before the Hearing Examiner who may take the ruling under advisement, or may rule from the bench on the matter. After the record is closed pursuant to the show cause hearing, all motions must be in writing.
