Section 150:1-11-6 - Hearing examiner

(a) The hearing examiner for administrative appeals regarding individual proceedings shall be the General Counsel of the Department of Commerce unless it is determined that a conflict exists regarding the particular matter at issue.

(b) In the event the hearing examiner must disqualify, the Executive Director shall appoint an alternate hearing examiner who must be a licensed attorney at law.

(c) Any party may request disqualification of the hearing examiner by filing an affidavit with the Executive Director, stating the specific grounds upon which the request is made.

(d) The Director shall promptly make a determination either granting or denying the request. Denial of the request is not an appealable order.
