Section 150:1-11-3 - Filing

(a) The date of filing for a petition for a hearing shall be the date on which the petition is received in the main office according to the date and time stamp of the Department.

(b) The Department must receive a petition in regard to an action or decision of the Department within thirty (30) days of the Department action adversely affecting the individual petitioner in order for the petition to be valid. If the petition is not timely filed, it may be dismissed by the Department.
