EXECUTIVE ORDER 2024-4
I, J. Kevin Stitt, Governor of the State of Oklahoma, pursuant to the authority vested in me by Sections 1 and 2 of the Article VI of the Oklahoma Constitution and 63 O.S. §683.1, et. seq. hereby declare that because of extraordinary conditions in Oklahoma due to wildfires in Oklahoma and Texas, it is necessary to expedite access to water, hay, and other feed for livestock. In order to accommodate this need and to provide assistance to farmers and ranchers in this extraordinary situation, the following vehicle registration, size, and weight requirements are suspended, effective March 6, 2024, for operators of commercial vehicles to travel in and through the state of Oklahoma to deliver water, hay, and other feed for livestock in furtherance of providing disaster assistance in Oklahoma, subject to the restrictions listed in this notice:
1. the International Registration Plan (IRP) vehicle registration requirements under 47 O.S.§1120, et. seq., to the extent the vehicle is not already registered under the IRP and as long as the vehicle is registered in one of the 48 contiguous states of the United States; and
2. the oversize and overweight permitting requirements for all divisible and non-divisible vehicles and loads under 47 O.S. §14-101 et. seq.
Nothing contained in this declaration shall be construed as an exemption from the Controlled Substance and Alcohol Use and Testing requirements ( 49 C.F.R. Part 382), the Commercial Driver License requirements ( 49 C.F.R. Part 383), the Financial Responsibility requirements ( 49 C.F.R. Part 387), or any other portion of the regulations not specifically identified herein. Motor carriers that have an Out-of-Service Order in effect cannot take advantage of the relief from regulation that this declaration provides. This Order applies only to the transportation of agriculture feed products to provide direct assistance associated with this extraordinary event. No other products are covered by the exemption and suspension under this Order. This notice will remain in effect for 14 days.
Copies of this Executive Order shall be distributed to the Director of Emergency Management and Homeland Security, Department of Public Safety, Department of Agriculture, Food, & Forestry, Department of Transportation, Oklahoma Corporation Commission, and the Oklahoma Tax Commission, who shall cause the provisions of this Order to be implemented by all appropriate agencies of State government.
