In 2019, the Oklahoma legislature passed, and I signed House Bill 2612, which added to the list of information that public bodies are required to make available on their websites. The additional requirement related to the disclosure of how a public body stores personally identifiable data and with whom the information is shared. To date, most, but not all, public bodies have complied with this additional disclosure requirement. Compliance with state law is, and will continue to be, the expectation of every employee of the Executive Branch.

As a result, therefore, I, J. Kevin Stitt, Governor of the State of Oklahoma, by the authority vested in me pursuant to Sections 1 and 2 of Article VI of the Oklahoma Constitution, and to ensure compliance with 74 O.S. § 3106.4, hereby direct all "state agencies," as defined by 61 O.S. § 327(A), as follows:

1. On or before August 1, 2022, provide the appropriate Cabinet Secretary written notification of the following:

a. Whether the agency has complied with 74 O.S. § 3106.4; and

b. If the agency has not complied, a detailed explanation as to the reason(s) for non-compliance and all steps taken to become compliant.

I further direct all Cabinet Secretaries to work with the state agencies under their respective purview to ensure compliance with 74 O.S. §3106.4 and report to the Governor's Office any refusal to comply by September 1, 2022.

Copies of this Executive Order shall be distributed to the chief executives of every State agency, board, and commission for immediate implantation. Copies of this Executive Order shall also be distributed to each Cabinet Secretary.
