Today, I signed into law Enrolled Senate Bill 1929. This Bill makes several amendments to the Oklahoma Cosmetology and Barbering Act and imposes duties on the State Board of Cosmetology and Barbering. Specifically, one amendment in section 199.3(B)(3) states, "Notwithstanding any other provision of law to the contrary, records and information obtained in connection with an investigation of alleged violations, including complaints, identity of a complainant, investigative reports, and documentation or images generated or received during the course of an investigation, shall be confidential and shall not be subject to disclosure." This amendment codifies the Board's obligations imposed by the Open Records Act, and does not expand or reduce their obligation to disclose records when requested pursuant to the Open Records Act.

Therefore, the State Board of Cosmetology and Barbering shall not construe this law to expand or abrogate any requirement currently existing in the Open Records Act. I hereby direct the State Board of Cosmetology and Barbering to fully comply with the Open Records Act as it is written.

This Executive Order shall be distributed to the director of the State Board of Cosmetology and Barbering and the Secretary of Health and Human Services, who shall cause the provisions of this Order to be implemented as herein directed.
