Section 4101:9-4-03 - Discharge of prevailing wage obligation

(A) An employer shall pay not less than the prevailing wage rate as determined by the director in the following manner:
(1) Payment of the basic hourly rate of pay
directly to the employee plus payment of the rate of contribution and rate of
costs permitted under division-level 4101:9 rules of the Administrative Code;
or
(2) Where there is no rate of
contribution or rate of costs as permitted under these rules, the basic hourly
rate of pay shall be at least equal to the prevailing wage rate and shall be
paid in full directly to the employee.
(B) No fringe benefits may be considered in the determination of prevailing wages if federal, state, or local law requires employers to provide any of such benefits.
