Section 3770:1-9-745 - Game rule number seven hundred forty-five

(A) Title and term. Ohio lottery commission game rule number seven hundred forty-five. "Lucky Millionaire" shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred forty-five.

(B) General design.

(1) Game rule number seven hundred forty-five is a key number match game with a "multiplier" feature and is generally known as an "instant lottery."

(2) The holder of a valid ticket will remove the covering over the entire play area to reveal six "Winning Numbers." twenty "Your Number(sV and twenty corresponding prize values. If any one or more of "Your Number(sV matches one or more of the "Winning Numbers." the player wins the corresponding prize value(s^) shown below the matching "Your Number(sY" If the player reveals a "Lucky" symbol in any of "Your Numbers" play spots, the player wins the corresponding prize value automatically. If the player reveals a "Double Dollar Sign" symbol in any of the "Your Numbers" play spots, the player wins double the corresponding prize automatically. If the player reveals a "IPX" symbol in any of "Your Numbers" play spots, the player wins ten times the corresponding prize value shown automatically. If the player reveals a "20X" symbol in any of the "Your Numbers" play spots, the player wins twenty times the corresponding prize value shown automatically. If the player matches any of "Your Numbers" to one of the "Winning Numbers" and the corresponding prize value revealed is a "TPD" symbol, the player wins five thousand five hundred dollars automatically, and upon the filing of a valid claim at an Ohio lottery commission office, shall automatically be entered into the Top Prize Drawing ("TPD"^) for a chance to win an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award." The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director. There are twenty chances to win on each ticket, and a player may win up to twenty times on one ticket.

(3) The only "prize values" which shall appear on a ticket in game rule number seven hundred forty-five are: ten dollars, twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars, one thousand dollars, the "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, ten thousand dollars, twenty thousand dollars and an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award." Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred forty-five shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

(C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred forty-five shall be twenty dollars.

(D) Structure, nature and value of prize awards

(1) There shall be two types of prizes in game rule seven hundred forty-five, a "regular prize award" and a "TPD" prize award.

(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand five hundred dollars, ten thousand dollars, twenty thousand dollars and an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award." Each ticket in game rule number seven hundred forty-five shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of the "Your Numbers" play spots for ten dollars doubled shall win a regular prize award of twenty dollars;

(b) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars two times shall win a regular prize award of twenty dollars;

(c) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once shall win a regular prize award of twenty dollars;

(d) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty-five dollars once shall win a regular prize award of twenty-five dollars;

(e) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for ten dollars three times shall win a regular prize award of thirty dollars;

(f) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars once and twenty dollars once shall win a regular prize award of thirty dollars;

(g) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for thirty dollars once shall win a regular prize award of thirty dollars;

(h) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for ten dollars four times shall win a regular prize award of forty dollars;

(i) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for ten dollars two times and twenty dollars once shall win a regular prize award of forty dollars;

(j) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for twenty dollars two times shall win a regular prize award of forty dollars;

(k) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of "Your Numbers" play spots for twenty dollars doubled shall win a regular prize award of forty dollars;

(l) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for forty dollars once shall win a regular prize award of forty dollars;

(m) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for ten dollars five times shall win a regular prize award of fifty dollars;

(n) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for ten dollars three times and twenty dollars once shall win a regular prize award of fifty dollars;

(o) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for twenty dollars two times and ten dollars once shall win a regular prize award of fifty dollars;

(p) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars doubled shall win a regular prize award of fifty dollars;

(q) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of fifty dollars;

(r) Holder of a valid winning ticket on which a "IPX" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times ten shall win a regular prize award of one hundred dollars;

(s) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by five of "Your Numbers" for twenty dollars five times shall win a regular prize award of one hundred dollars;

(t) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for twenty-five dollars four times shall win a regular prize award of one hundred dollars;

(u) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of "Your Numbers" play spots for fifty dollars doubled shall win a regular prize award of one hundred dollars;

(v) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" for twenty dollars three times and ten dollars four times shall win a regular prize award of one hundred dollars;

(w) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of one hundred dollars;

(x) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for one hundred dollars two times, and on which a "IPX" symbol is revealed in one of "Your Numbers" play spots for twenty-five dollars times ten and fifty dollars once, shall win a regular prize award of five hundred dollars;

(y) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of "Your Numbers" play spots for two hundred fifty dollars doubled shall win a regular the prize award of five hundred dollars.

(z) Holder of a valid winning ticket on which a "2PX" symbol is revealed in one of "Your Numbers" play spots for twenty-five dollars times twenty shall win a regular prize award of five hundred dollars;

(aa) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" for twenty-five dollars twenty times shall win a regular prize award of five hundred dollars;

(bb) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twelve of "Your Numbers" for forty dollars ten times and fifty dollars two times shall win a regular prize award of five hundred dollars;

(cc) Holder of a valid winning ticket on which a "IPX" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times ten shall win a regular prize award of five hundred dollars;

(dd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for one hundred dollars five times shall win a regular prize award of five hundred dollars;

(ee) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five hundred dollars once shall win a regular prize award of five hundred dollars;

(ff) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times twenty shall win a regular prize award of one thousand dollars;

(gg) Holder of a valid winning ticket on which a "IPX" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times ten shall win a regular prize award of one thousand dollars;

(hh) Holder of a valid winning ticket on which a "Double Dollar Sign" symbol is revealed in one of "Your Numbers" play spots for five hundred dollars doubled shall win a regular prize award of one thousand dollars;

(ii) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one thousand dollars once shall win a regular prize award of one thousand dollars;

(jj) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and a "TPD" prize symbol is revealed for five thousand five hundred dollars shall win a regular prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a prize of an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award;"

(kk) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of "Your Numbers" play spots for five hundred dollars times twenty shall win a regular prize award often thousand dollars;

(ll) Holder of a valid winning ticket on which a "IPX" symbol is revealed in one of "Your Numbers" play spots for one thousand dollars times ten shall win a regular prize award often thousand dollars;

(mm) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" for five hundred dollars twenty times shall win a regular prize award of ten thousand dollars;

(nn) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten thousand dollars once shall win a regular prize award often thousand dollars;

(oo) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars;

(pp) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for one thousand dollars times twenty shall win a regular prize award of twenty thousand dollars; and

(qq) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" to win an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award."

(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred forty-five will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by. but not limited to. circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five million tickets sold should be as follows:
(a) Four tickets matching numbers for the "Annuity Prize Award" of one hundred thousand dollars for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award;

(b) Ten tickets revealing the "20X" symbol for one thousand dollars times twenty to win twenty thousand dollars; and (c) Ten tickets matching numbers for twenty thousand dollars once to win twenty thousand dollars;

(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:
(a) One ticket matching numbers for ten thousand dollars once to win ten thousand dollars;

(b) One ticket matching numbers for five hundred dollars twenty times to win ten thousand dollars;

(c) One ticket revealing the "IPX" symbol for one thousand dollars times ten to win ten thousand dollars;

(d) One ticket revealing the "20X" symbol for five hundred dollars times twenty to win ten thousand dollars;

(e) One ticket revealing the "TPD" symbol to win five thousand five hundred dollars, and upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a grand prize of an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award;

(f) Ten tickets matching numbers for one thousand dollars once to win one thousand dollars;

(g) Forty-five tickets revealing the "Double Dollar Sign" symbol for five hundred dollars doubled to win one thousand dollars;

(h) Twenty tickets revealing the "IPX" symbol for one hundred dollars times ten to win one thousand dollars;

(i) Twenty-five tickets revealing the "20X" symbol for fifty dollars times twenty to win one thousand dollars;

(j) Fifty tickets matching numbers for five hundred dollars once to win five hundred dollars;

(k) Fifty tickets matching numbers for one hundred dollars five times to win five hundred dollars;

(l) One hundred tickets revealing the "IPX" symbol for fifty dollars times ten to win five hundred dollars;

(m) One hundred tickets matching numbers for forty dollars ten times and fifty dollars two times to win five hundred dollars;

(n) One hundred tickets matching numbers for twenty-five dollars twenty times to win five hundred dollars;

(o) Two hundred tickets revealing the "20X" symbol for twenty-five dollars times twenty to win five hundred dollars;

(p) One hundred fifty tickets revealing the "Double Dollar Sign" symbol for two hundred fifty dollars doubled to win five hundred dollars;

(q) One hundred tickets matching numbers for one hundred dollars two times, and fifty dollars once, and revealing the "IPX" symbol once for twenty-five dollars times ten to win five hundred dollars;

(r) One thousand one hundred tickets matching numbers for one hundred dollars once to win one hundred dollars;

(s) One thousand one hundred tickets matching numbers for twenty dollars three times and ten dollars four times to win one hundred dollars;

(t) Two thousand tickets revealing the "Double Dollar Sign" symbol for fifty dollars doubled to win one hundred dollars;

(u) One thousand two hundred tickets matching numbers for twenty-five dollars four times to win one hundred dollars;

(v) One thousand tickets matching numbers for twenty dollars five times to win one hundred dollars;

(w) One thousand six hundred tickets revealing the "IPX" symbol for ten dollars times ten to win one hundred dollars;

(x) One thousand tickets matching numbers for fifty dollars once to win fifty dollars;

(y) Two thousand tickets revealing the "Double Dollar Sign" symbol for twenty-five dollars doubled to win fifty dollars;

(z) One thousand tickets matching numbers for twenty dollars two times and ten dollars once to win fifty dollars;

(aa) One thousand tickets matching numbers for ten dollars three times and twenty dollars once to win fifty dollars;

(bb) One thousand tickets matching numbers for ten dollars five times to win fifty dollars;

(cc) Three hundred tickets matching numbers for forty dollars once to win forty dollars;

(dd) One thousand five hundred tickets revealing the "Double Dollar Sign" symbol for twenty dollars times two to win forty dollars;

(ee) Three hundred tickets matching numbers for twenty dollars two times to win forty dollars;

(ff) Three hundred twenty-five tickets matching numbers for ten dollars two times and twenty dollars once to win forty dollars;

(gg) Four hundred tickets matching numbers for ten dollars four times to win forty dollars;

(hh) Five hundred tickets matching numbers for thirty dollars once to win thirty dollars;

(ii) Five hundred tickets matching numbers for ten dollars once and twenty dollars once to win thirty dollars;

(jj) Five hundred tickets matching numbers for ten dollars three times to win thirty dollars;

(kk) Sixteen thousand tickets matching numbers for twenty-five dollars once to win twenty-five dollars;

(ll) Four thousand tickets matching numbers for twenty dollars once to win twenty dollars;

(mm) Four thousand tickets matching numbers for ten dollars two times to win twenty dollars; and

(nn) Sixteen thousand tickets revealing the "Double Dollar Sign" symbol for ten dollars doubled to win twenty dollars.

(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

(G) Frequency of prize drawings.

(1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred forty-five shall be accomplished in a manner, which complies with the commission's rules and procedures.

(2) When a ticket issued in game rule number seven hundred forty-five is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred forty-five in which the ticket was sold.

(3) The Top Prize Drawing to award one prize of an "Annuity Prize Award" of one hundred thousand dollars per year for twenty years before taxes or the "Elected Cash-Option Prize Award" of approximately one million dollars before taxes in lieu of the "Annuity Prize Award" shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing"Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing"Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.

(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(I) Validity of Tickets.

(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2) In addition to. but not in limitation of. all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred forty-five void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered. reconstituted, miscut. defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(J) Director's conduct of game rule number seven hundred forty-five.

(1) The director shall conduct game rule number seven hundred forty-five and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred forty-five. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

(2) Names and definitions of elements of game rule seven hundred forty-five used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred forty-five and these elements may be given names or titles chosen by the commission.
