(A) Title and term. Ohio lottery commission game rule number one hundred forty two, "Instant Millions," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number one hundred forty two.
(B) General design.
(1)
Game rule number
one hundred forty two is a key number match game with a "Bonus" multiplying
feature, a "Fast" play area, and is generally known as an "instant
lottery."
(2)
Holders of valid tickets will remove the covering off
the entire play area to reveal six "Winning Numbers," fifteen "Your Numbers,"
fifteen corresponding prize values and fifteen "Bonus" numbers. If any one or
more of "Your Numbers" matches one or more of the "Winning Numbers," the player
wins the corresponding prize value shown below the matching "Your Numbers." The
player will then scratch the "Bonus" number play area under which a number will
be revealed. The player will multiply the prize amount under "Your Number" by
the "Bonus" number revealed to determine your winning prize for that matching
number. "Bonus" numbers may include the numbers "1X," "2X," "3X," "4X," "5X,"
"10X," "20X," "25X," and "50X." If the player reveals a "Star" symbol, the
player wins the corresponding prize automatically. If the player reveals an
"INSTANT" symbol, the player wins an "Annuity Prize Award" of fifty thousand
dollars per year for twenty years before taxes or the "Elected Cash-Option
Prize Award" of five hundred thousand dollars. If the player reveals a
"FIFTY$," HUNDRED$," or "FIVE HUNDRED$," symbol in the "Fast" play area, the
player wins the corresponding prize award. If the player matches any one of
"Your Numbers" to one of the "Winning Numbers" and the corresponding prize
value revealed is a "TPD" symbol, the player wins five thousand five hundred
dollars automatically, and, upon the filing of a valid claim at an Ohio lottery
commission office, shall also automatically be entered in the Top Prize Drawing
("TPD") for a chance to win an "Annuity Prize Award" of fifty thousand dollars
per year for twenty years before taxes or the "Elected Cash-Option Prize Award"
of five hundred thousand dollars in lieu of the "Annuity Prize Award." The Top
Prize Drawing shall be conducted in accordance with Ohio lottery rules and
procedures established and approved by the director. There are fifteen chances
to win on each ticket, and a player may win up to fifteen times on one
ticket.
(3)
The only "prize values" which shall appear on a ticket
in game rule number one hundred forty two are: one dollar, two dollars, three
dollars, four dollars, five dollars, ten dollars, fifteen dollars, twenty
dollars, twenty five dollars, fifty dollars, one hundred dollars, two hundred
fifty dollars, five hundred dollars, one thousand dollars, two thousand five
hundred dollars, the "TPD" symbol corresponding to a prize value of five
thousand five hundred dollars, ten thousand dollars, twenty thousand dollars,
and one million dollars. Numbers, prize values and play symbols appearing on
any ticket in game rule number one hundred forty two shall be concealed by an
opaque covering which may be scratched off by the holder of the ticket to
reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number one hundred forty two shall be ten dollars.
(D) Structure, nature and value of prize awards.
(1)
There shall be two types of prizes in game rule number
one hundred forty two, a "regular prize award" and a "TPD" prize
award.
(2)
As used in this rule, "prize award" shall mean one of
the following monetary figures which is the total of all winning prize values
appearing on the ticket: ten dollars, fifteen dollars, twenty dollars, twenty
five dollars, fifty dollars, one hundred dollars, two hundred fifty dollars,
five hundred dollars, one thousand dollars, two thousand five hundred dollars,
five thousand five hundred dollars, ten thousand dollars, twenty thousand
dollars, five hundred thousand dollars and one million dollars. Each ticket in
game rule number one hundred forty two shall be imprinted in such a way that
prize awards from the set listed above may be won.
(a)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play
spots for ten dollars once with a multiplying "Bonus" number of "1X" shall win
a regular prize award of ten dollars;
(b)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by two of "Your Numbers" or a "Star" symbol is revealed in two play spots, or
any combination thereof, for five dollars two times with a multiplying "Bonus"
number of "1X" shall win a regular prize award of ten dollars;
(c)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for five dollars
once with a multiplying "Bonus" number of "2X" shall win a regular prize award
of ten dollars;
(d)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for fifteen dollars once with a multiplying "Bonus"
number of "1X" shall win a regular prize award of fifteen
dollars;
(e)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for three dollars once with a multiplying "Bonus"
number of "5X" shall win a regular prize award of fifteen
dollars;
(f)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for one
dollar once with a multiplying "Bonus" number of "10X" and five dollars once
with a multiplying bonus of "1X" shall win a regular prize award of fifteen
dollars;
(g)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for five dollars once with a multiplying "Bonus"
number of "3X" shall win a regular prize award of fifteen
dollars;
(h)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by three of "Your Numbers" or a "Star"
symbol is revealed in three play spots, or any combination thereof, for five
dollars three times with a multiplying "Bonus" number of "1X" shall win a
regular prize award of fifteen dollars;
(i)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by two of "Your Numbers" or a "Star" symbol is revealed in two play spots, or
any combination thereof, for two dollars once with a multiplying "Bonus" number
of "5X" and five dollars once with a multiplying "Bonus" number of "1X" shall
win a regular prize award of fifteen dollars;
(j)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for twenty
dollars once with a multiplying "Bonus" number of "1X" shall win a regular
prize award of twenty dollars;
(k)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for ten dollars
once with a multiplying "Bonus" number of "2X" shall win a regular prize award
of twenty dollars;
(l)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for one dollar once with a multiplying "Bonus" number
of "20X" shall win a regular prize award of twenty dollars;
(m)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for two dollars
once with a multiplying "Bonus" number of "10X" shall win a regular prize award
of twenty dollars;
(n)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for five
dollars two times with a multiplying "Bonus" number of "2X" shall win a regular
prize award of twenty dollars;
(o)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for four dollars
once with a multiplying "Bonus" number of "5X" shall win a regular prize award
of twenty dollars;
(p)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for one
dollar once with a multiplying "Bonus" number of "10X" and two dollars once
with a multiplying "Bonus" number of "5X" shall win a regular prize award of
twenty dollars;
(q)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star"
symbol is revealed in four play spots, or any combination thereof, for five
dollars four times with a multiplying "Bonus" number of "1X" shall win a
regular prize award of twenty dollars;
(r)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by two of "Your Numbers" or a "Star" symbol is revealed in two play spots, or
any combination thereof, for ten dollars once with a multiplying "Bonus" number
of "2X" and five dollars once with a multiplying "Bonus" number of "1X" shall
win a regular prize award of twenty five dollars;
(s)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for five dollars
once with a multiplying "Bonus" number of "5X" shall win a regular prize award
of twenty five dollars;
(t)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for five
dollars once with a multiplying "Bonus" number of "2X" and five dollars once
with a multiplying "Bonus" number of "3X" shall win a regular prize award of
twenty five dollars;
(u)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" is matched by two of "Your Numbers" or a "Star" symbol
is revealed in two play spots, or any combination thereof, for five dollars
once with a multiplying "Bonus" number of "4X" and five dollars once with a
multiplying "Bonus" number of "1X" shall win a regular prize award of twenty
five dollars;
(v)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by three of "Your Numbers" or a "Star"
symbol is revealed in three play spots, or any combination thereof, for one
dollar once with a multiplying "Bonus" number of "10X," two dollars once with a
multiplying "Bonus" of "5X," and five dollars once with a multiplying "Bonus"
of "1X" shall win a regular prize award of twenty five dollars;
(w)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by three of "Your Numbers" or a "Star" symbol is revealed in three play spots,
or any combination thereof, for ten dollars two times with a multiplying
"Bonus" number of "1X" and five dollars once with a multiplying "Bonus" number
of "1X" shall win a regular prize award of twenty five dollars;
(x)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by five of "Your Numbers" or a "Star" symbol is revealed in five play spots, or
any combination thereof, for five dollars five times with a multiplying "Bonus"
number of "1X" shall win a regular prize award of twenty five
dollars;
(y)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for twenty five dollars once with a multiplying
"Bonus" number of "1X" shall win a regular prize award of twenty five
dollars;
(z)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for twenty five dollars once with a multiplying
"Bonus" number of "2X" shall win a regular prize award of fifty
dollars;
(aa)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star"
symbol is revealed in ten play spots, or any combination thereof, for five
dollars ten times with a multiplying "Bonus" number of "1X" shall win a regular
prize award of fifty dollars;
(bb)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for ten dollars
once with a multiplying "Bonus" number of "5X" shall win a regular prize award
of fifty dollars;
(cc)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for five dollars once with a multiplying "Bonus"
number of "10X" shall win a regular prize award of fifty
dollars;
(dd)
Holder of a valid winning ticket on which a "FIFTY$"
symbol is revealed in the "Fast $50" play area shall win a regular prize award
of fifty dollars;
(ee)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for one dollar once with a multiplying "Bonus" number
of "50X" shall win a regular prize award of fifty dollars;
(ff)
Holder of a
valid winning ticket on which one of the "Winning Numbers" is matched by one of
"Your Numbers" or a "Star" symbol is revealed in one play spot for two dollars
once with a multiplying "Bonus" number of "25X" shall win a regular prize award
of fifty dollars;
(gg)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for twenty
five dollars twice with a multiplying "Bonus" number of "1X" shall win a
regular prize award of fifty dollars;
(hh)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by six of "Your Numbers" or a "Star" symbol is revealed in six play spots, or
any combination thereof, for ten dollars four times with a multiplying "Bonus"
number of "1X" and for five dollars two times with a multiplying "Bonus" number
of "1X" shall win a regular prize award of fifty dollars;
(ii)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by eight of "Your Numbers" or a "Star" symbol is revealed in eight play spots,
or any combination thereof, for five dollars six times with a multiplying
"Bonus" number of "1X" and for ten dollars two times with a multiplying "Bonus"
number of "1X" shall win a regular prize award of fifty
dollars;
(jj)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for fifty dollars once with a multiplying "Bonus"
number of "1X" shall win a regular prize award of fifty
dollars;
(kk)
Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for five dollars with a multiplying "Bonus" number of
"20X" shall win a regular prize award of one hundred dollars;
(ll)
Holder of a
valid winning ticket on which one or more of the "Winning Numbers" are matched
by five of "Your Numbers" or a "Star" symbol is revealed in five play spots, or
any combination thereof, for twenty dollars five times with a multiplying
"Bonus" number of "1X" shall win a regular prize award of one hundred
dollars;
(mm)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by all fifteen of "Your Numbers" or a
"Star" symbol is revealed in all fifteen play spots, or any combination
thereof, for five dollars twelve times with a multiplying "Bonus" number of
"1X," ten dollars two times with a multiplying bonus of "1X," and twenty
dollars once with a multiplying "Bonus" of "1X" shall win a regular prize award
of one hundred dollars;
(nn)
Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star"
symbol is revealed in ten play spots, or any combination thereof, for ten
dollars ten times with a multiplying "Bonus" number of "1X" shall win a regular
prize award of one hundred dollars;

Holder of a

revealed in one play spot for fifty dollars once with a multiplying "Bonus"
number of "5X" shall win a regular prize award of two hundred fifty

symbol is revealed in five play spots, or any combination thereof, for fifty
dollars five with a multiplying "Bonus" number of "1X" shall win a regular
prize award of two hundred fifty dollars;

any combination thereof, for twenty five dollars ten times with a multiplying
"Bonus" number of "1X" shall win a regular prize award of two hundred fifty
dollars;

prize award of two hundred fifty dollars;

once with a multiplying "Bonus" number of "20X" and on which a "FIFTY$" symbol
is revealed in the "Fast $50" play area shall win a regular prize award of two
hundred fifty dollars;

revealed in one play spot for twenty five dollars once with a multiplying
"Bonus" number of "10X" shall win a regular prize award of two hundred fifty

Holder of a valid winning ticket on which one of the
"Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is
revealed in one play spot for two hundred fifty dollars once with a multiplying
"Bonus" number of "1X" shall win a regular prize award of two hundred fifty
dollars;

Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star"
symbol is revealed in two play spots, or any combination thereof, for ten
dollars two times with a multiplying "Bonus" number of "20X" and on which a
"HUNDRED$" symbol is revealed in the "Fast $100" play area shall win a regular
prize award of five hundred dollars;

Holder of a valid winning ticket on which one or more
of the "Winning Numbers" are matched by all fifteen of "Your Numbers" or a
"Star" symbol is revealed in all fifteen play spots, or any combination thereof
for twenty five dollars ten times with a multiplying "Bonus" number of "1X" and
fifty dollars five times with a multiplying "Bonus" of "1X" shall win a regular
prize award of five hundred dollars;

"Your Numbers" or a "Star" symbol is revealed in one play spot for ten dollars

(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number one hundred forty two will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1)
Combinations winning each prize award are randomly
distributed throughout all tickets printed in any given ticket issuance;
and
(2)
Mathematical reasoning indicates that over a
sufficiently large number of tickets sold, the average number of winning
tickets per seven million tickets sold should be as follows:

(G) Frequency of prize drawings.
(1)
Random
imprinting of prize awards on all tickets issued in game rule number one
hundred forty two shall be accomplished in a manner, which complies with the
commission's rules and procedures.
(2)
When a ticket
issued in game rule number one hundred forty two is sold or deemed sold in
accordance with this rule and the covering material over any of the numbers,
prize values and play symbols has been removed, the holder shall be deemed to
have drawn the numbers, prize values and play symbols on that ticket which
determine whether the holder is entitled to a regular prize award. All regular
prize awards shall be deemed announced no later than the last day of the sales
cycle of game rule number one hundred forty two in which the ticket was
sold.
(3)
The Top Prize Drawing to award one grand prize of one
million dollars or the "Elected Cash-Option Prize Award" of five hundred
thousand dollars shall take place in accordance with rules and procedures
established and approved by the director, and specifically, rule
3770:1-6-05 of the
Administrative Code governing "Prize drawings" and rule
3770:1-6-06
of the Administrative Code governing "Special lottery drawings." Such drawings
shall be held on dates determined and announced by the director, however, the
earliest Top Prize Drawing date shall be one hundred eighty days from the game
close date or when all tickets winning a prize value corresponding with a "TPD"
symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1)
A mechanical
error in printing prize awards, symbols, words or other numbers on a ticket
shall not automatically invalidate that ticket. To the extent feasible, the
director shall establish procedures by which the holder of any ticket on which
information is incorrectly printed due to mechanical malfunction may be advised
of correct information for the ticket. If it is not technically feasible to
recover the information from a mechanically misprinted ticket, the director may
declare the ticket void and the holder shall be entitled to a return of the
ticket price or a replacement ticket of comparable price.
(2)
In addition to,
but not in limitation of, all other power and authority conferred on the
director by the commission's rules, the director may declare a ticket in game
rule number one hundred forty two void if it is stolen, unissued, deactivated,
not sold or deemed not sold in accordance with commission rules; if it is
illegible, mutilated, altered, counterfeit, misregistered, reconstituted,
miscut, defective, printed or produced in error or incomplete; or if the ticket
fails any of the validation tests or procedures established by the director.
The commission's liability and responsibility for a ticket declared void, if
any, is limited to refund of the retail sales price of the ticket or issuance
of a replacement ticket of comparable price.
(J) Director's conduct of game rule number one hundred forty two.
(1)
The director
shall conduct game rule number one hundred forty two and any drawings or
promotions associated therewith in a manner consistent with the Lottery Act and
the rules of the commission including, without limitation, this rule and the
regulations of the director. As deemed necessary or advisable, the director
shall adopt management regulations, orders or directives to implement and
operate this lottery game and any drawings or promotions associated therewith.
The director shall inform the public of the provisions of this rule and the
procedures established pursuant hereto which affect the play of game rule
number one hundred forty two. The director reserves the right to declare any
instant game as unavailable for sale at any time to maintain game integrity and
accountability.
(2)
Names and definitions of elements of game rule number
one hundred forty two used in this rule are to be considered generic terms used
solely for purposes of this rule. In actual operation, game rule number one
hundred forty two and these elements may be given names or titles chosen by the
commission.
