(A) Procedures for emission offsets.
Emission offsets may be proposed by either the owner or operator of the proposed major stationary source or by the local community or the state. The emission reduction committed to shall be enforceable by authorized state or local agencies and under the Clean Air Act, and be accomplished by the new major stationary source's start-up date. If emission reductions are to be obtained in a state that neighbors the state in which the new major stationary source is to be located, the emission reductions committed to shall be enforceable by the neighboring state or local agencies and under the Clean Air Act. Where the new major stationary source is a replacement for a major stationary source that is being shut down in order to provide the necessary offsets, the director may allow up to one hundred eighty days for shakedown of the new major stationary source before the existing major stationary source is required to cease operation.
