Section 3745-273-06 - Applicability- aerosol cans

(A) Aerosol cans covered under Chapter 3745-273 of the Administrative Code. Chapter 3745-273 of the Administrative Code applies to persons managing aerosol cans, as defined in rule 3745-273-09 of the Administrative Code, except those listed in paragraph (B) of this rule.
(B) Aerosol cans not covered under Chapter 3745-273 of the Administrative Code. Chapter 3745-273 of the Administrative Code does not apply to persons managing the following types of aerosol cans:
(1)
Aerosol cans that
are not yet waste under Chapter 3745-51 of the Administrative Code. Paragraph
(C) of this rule describes when an aerosol can becomes a waste;
(2)
Aerosol cans that
are not hazardous waste. An aerosol can is a hazardous waste if the aerosol can
exhibits one or more of the characteristics identified in rules
3745-51-20 to
3745-51-24 of the Administrative
Code or the aerosol can contains a substance that is listed in
3745-51-30 to
3745-51-35 of the Administrative
Code; and
(3)
Aerosol cans that meet the standard for empty
containers under rule
3745-51-07 of the Administrative
Code.
(C) Generation of waste aerosol cans.
(1)
A used aerosol
can becomes a waste on the date the used aerosol can is
discarded.
(2)
An unused aerosol can becomes a waste on the date the
handler decides to discard the unused aerosol can.
