Section 3701-12-11 - Opportunity to submit written comments during the course of a certificate of need review

(A) Any affected person may submit written comments regarding an application for a certificate of need.
(1) Such comments must be received by the
following deadlines:
(a) For applications
under a standard review, by the forty-fifth day after the application is
accepted for processing by the director; or
(b) For an application for which an expedited
review was requested in accordance with paragraph (D)(6) of rule
3701-12-08 of the Administrative
Code, by the twenty-first day after the application is accepted for processing
by the director.
(2) The
director shall consider all written comments received by the established
deadlines.
(B) For the purpose of this rule, the date the application is "accepted," means the date the application is made available to the public for review on the Ohio department of health certificate of need project website at http://publicapps.odh.ohio.gov/EID/ reports/EID_Report_Criteria.aspx?type=con.
