Section 75-03-21-15 - Bases for license action - Permitting operation after notice of revocation

The department may revoke or deny a license for any of the reasonspermitted in law, or any combination of reasons. A revocation or denial basedon more than one reason must be affirmed, on appeal, if the evidence supportsany reason given for revocation or denial. A provider who receives a notice ofrevocation, and who makes a timely appeal of that notice, may continue to operatethe facility pending a final administrative appeal decision, unless the revocation isbased upon reasons which present an imminent danger to the health, welfare, orsafety of residents or unless the license expires.
