Section 75-03-21.1-42 - Permitting operation after notice of revocation

The department may revoke or deny a license for any of the reasons permitted by law, or any combination of reasons. A revocation or denial based on one or more reasons must be affirmed, on appeal, if the evidence supports any reason given for revocation or denial. An agency that receives a notice of revocation, and that makes a timely appeal of that notice, may continue to operate the facility pending a final administrative appeal decision, unless the license expires. If the revocation is based on reasons which present an imminent danger to the health, welfare, or safety of residents, an agency may not provide care to a resident pending a final administrative appeal decision.
