A preliminary inquiry decision shall be made by:

(1) The full Commission if the complaint is received from one of the following:

(a) any member of the Commission;

(b) a duly constituted panel of the Commission; or

(c) Commission staff.

(2) A Commission panel if the complaint is received from one of the following:

(a) a local, state or federal agency referral; or

(b) a third-party complainant.
