(a) An employment applicant whose application is rejected for medical reasons or a member who is dismissed or transferred from his/her job for medical reasons may appeal the decision to the Department Secretary, through the chief of the BPS Division.

(b) The chief will collect all pertinent information on the case and present the appeal and the background information to the Secretary.

(c) Within 15 days of receipt of the appeal, the Secretary shall hear the case and give a decision in writing to the applicant or member and to the chief.

(d) If the applicant or member is not satisfied with the decision of the Secretary, he/she may appeal as provided by state law. The applicant may contact the departmental personnel office for assistance in the appeal.
