(a) The hearing officer shall have control over the hearing, including:
(1) the responsibility of having a record
made of the hearing;
(2) the
administration of oaths and affirmations;
(3) recognition of speakers;
(4) prevention of repetitious presentations;
and
(5) general management of the
hearing.
(b) The hearing officer shall conduct the hearing in a manner that will provide the applicant or client the rights required by 34 C.F.R. 361.57(b)(3).
(c) The hearing shall not be open to the public.
