(a) Except as cited in (b) of this Rule, individuals must be determined eligible in accordance with the same criteria as for developmental day state grant-in-aid funds.
(b) Subject to prior approval by the regional director or his designee, school aged children who are mildly retarded or who are otherwise developmentally disable may be determined eligible provided all other grant-in-aid eligibility criteria are met.
