(a) Except as cited in (b) of this Rule, individuals must be determined eligible in accordance with the same criteria as for developmental day state grant-in-aid funds.

(b) Subject to prior approval by the regional director or his designee, preschool children who are mildly retarded or who are otherwise developmentally disabled may be determined eligible provided all other grant-in-aid eligibility criteria are met.
