Section 8.85 - Executive Order No. 85: Continuing the Suspension or Modification of Certain Statutory Provisions Relating to Payment of Fees for Duplicate State-Issued Documents and Extension of Expiration Dates

WHEREAS, on October 26, 2012, I issued Executive Order Number 47, declaring a disaster emergency in all 62 counties in the State of New York; and

WHEREAS, Section 29-a of the Executive Law authorizes the suspension, alteration or modification of statutes, local laws, ordinances, orders, rules or regulations, or parts thereof, if compliance with such provisions would prevent, hinder or delay action necessary to cope with a disaster emergency; and

WHEREAS, on November 5, 2012, I issued Executive Order Number 62 to temporarily suspend certain provisions relating to the election law, and which Executive Order will expire on December 5, 2012; and

WHEREAS, on November 9, 2012, I issued Executive Order Number 69 to modify or suspend statutory provisions relating to payment of fees for duplicate state-issued documents and extension of expiration dates of certain state-issued documents to allow New Yorkers to replace documents destroyed as a result of the disaster and avoid penalty for late renewal of documents that they were unable to timely renew because of the disaster, and which Executive Order will expire on December 9, 2012; and

WHEREAS, Section 29-a of the Executive Law provides that no suspension of laws shall be made for a period in excess of thirty days, provided, however, that upon reconsideration of all of the relevant facts and circumstances, the suspension may be extended for additional thirty-day periods;

NOW, THEREFORE, I, ANDREW M. CUOMO, Governor of the State of New York, by virtue of the authority vested in me by Section 29-a of Article 2-B of the Executive Law, and after having reconsidered all of the relevant facts and circumstances, do hereby order the following:

The suspension of provisions of law ordered by Executive Order Number 62 shall continue through January 4, 2013;

The suspension of provisions of law ordered by Executive Order Number 69 shall continue through January 8, 2013 except that the suspension of the following provisions of the Vehicle and Traffic Law shall not be continued: Section 301, subdivision (3) of Section 401, subdivision (3) of Section 410, subdivision (2) of Section 491, subdivision (2) of Section 503, subdivision (4) of Section 2222, subdivision (9) of Section 2251, subdivision (3) of Section 2261, and subdivision (4) of Section 2282; and

Subdivision 2 of Section 3006 of the Education Law shall be suspended, for the period from the date of this Executive Order until further notice, to the extent that it requires payment of a fee for obtaining duplicate teaching certificates.
