WHEREAS, AIDS is the leading cause of death for 30 to 49 year old men, 20 to 49 year old women and 1 to 9 year old children in New York City and remains among the top five causes of death for all New York State men and women ages 20 to 59;

WHEREAS, New York State leads the nation in the country's cumulative AIDS incidence, with over 115,000 AIDS cases diagnosed and reported as of July 1997; and

WHEREAS, the State would like to ensure the continuation of the process that the New York State Department of Health and its AIDS Institute have been following to coordinate the State's policies with respect to AIDS in order to increase efficiency and reduce duplication of efforts among agencies;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the New York State Interagency Task Force on HIV/AIDS.

I. Membership

The Task Force shall consist of 17 members. Members of the Task Force shall include the Director of State Operations and the Commissioner of Health who shall serve as Co-Chairpersons; as well as the Commissioners of the Office of Children and Family Services, Office of Temporary and Disability Assistance, Office of Mental Health, Office of Alcoholism and Substance Abuse Services, Education Department, Department of Correctional Services, and Division of Housing and Community Renewal; and the Directors of the Division of Parole, Division of Probation and Correctional Alternatives, Division of the Budget, Division of Criminal Justice Services, Division for Women, Division of Human Rights and Council on Children and Families. Each Task Force member may designate a specific officer of his or her respective department(s), office, or division to represent him/her and exercise all the powers of such task force member as the case may be at all meetings of the task force from which such member may be absent.

II. Term of the New York State Interagency Task Force on HIV/AIDS

The task force shall be constituted for two years from the date of its creation and shall meet at least quarterly during the two year period.

III. Powers and Responsibilities

The task force shall undertake the following responsibilities:

a) coordination of programmatic and fiscal planning among the agencies, offices or divisions;

b) identification of areas of duplication and fragmentation among agencies, offices or divisions and development of a plan to address such problems and to promote efficiency and cost effectiveness;

c) development of plans for the education of agency personnel to increase awareness of HIV/AIDS issues, especially the potential consequences of programmatic decisions on persons affected by HIV/AIDS;

d) coordination of the implementation of specific HIV/AIDS policies and programs among all agencies;

e) development of a comprehensive list of programs which service persons affected with HIV/AIDS;

f) establishment of a collaborative relationship with the New York State AIDS Advisory Council to ensure the sharing of information on activities falling within the jurisdiction of both the task force and the Council. The Chairperson of the AIDS Advisory Council (or his or her designee) shall be invited to attend meetings of the Interagency Task Force; and g) development of a process for continuing interagency coordination following the term of the task force.

The Interagency Task Force shall make a report to the Governor at the end of its two year life, with respect to its deliberations, conclusions and any recommendations requiring Executive and/or legislative action.

IV. Assistance to the Task Force

All departments, agencies, divisions, boards and offices of the State are directed to cooperate with the task force and to provide such assistance as the task force may require to fulfill its purposes. Such purposes may include, but need not be limited to, the use of agency staff, the provision of statistical and policy data and consultation with staff as the task force may require.

Executive Order No. 99, promulgated on August 10, 1987, and continued unamended and unmodified on April 9, 1996, is revoked and superseded by this Executive Order as of the date hereof.
