Section 5.22 - Executive order no. 22: directing that the adjutant general order into active service the organizer militia to assist authorities in alleviating the effects of a severe snowstorm and guaranteeing public safety

WHEREAS, the Governor is Commander-in-chief of the Militia of the State, pursuant to the Constitution of the State, as restated in section 3 of the Military Law; and

WHEREAS, pursuant to the provisions of section 6 of the Military Law, the Governor as Commander-in-chief of the Militia has the power to order into the active service of the State in case of disaster or imminent danger thereof, such units of the organized militia which may be necessary to assist civil authority in disaster recovery efforts; and

WHEREAS, beginning on January 7, 1996, a severe snowstorm impacted New York City and the counties of Westchester, Putnam, Rockland, Orange, Nassau, and Suffolk disrupting vital public transportation and safety systems; and

WHEREAS, I have declared a disaster emergency in the aforementioned areas; and the public interest requires that the organized militia assist in alleviating the effects of the snowstorm and maintaining the public safety;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by paragraph one of section 6 of the Military Law, effective January 7, 1996, do hereby order Brigadier General John H. Fenimore, V, The Adjutant General, or, in his absence, his designee, to order into the active service of the State, for such period, to such extent and in such manner as he may deem necessary, all or any part of the organized militia to meet this emergency.

1. Brigadier General John H. Fenimore, V, The Adjutant General, or, in his absence, his designee, is appointed commander of all personnel ordered into the active service of the State.

2. Units and members of the organized militia who shall perform state active duty by order of The Adjutant General will immediately assemble at their local armories when so ordered, and will remain assembled pending further orders as to their disposition by The Adjutant General or his designee.

3. All enlistments, reenlistments or voluntary extensions of enlistments which expire after 7 January, 1996, or during the period for which the members are currently ordered into the active service of the state are hereby extended for the duration of such duty in the active service of the State.
