Section 4.62 - Executive Order No. 62: Declaring a disaster emergency in the Counties of Cattaraugus, Chautauqua, Erie, Genesee, Niagara, Orleans and contiguous areas. [*][DAGGER]
WHEREAS, commencing on February 23, 1985, heavy rain and unseasonably warm temperatures caused significant snow melt and ice jams which have resulted in flooding, causing personal hardship and damage to residential and commercial properties and the agricultural community, as well as the disruption of vital public transportation systems, within the Counties of Cattaraugus, Chautauqua, Erie, Genesee, Niagara, Orleans and contiguous areas;
NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, do hereby find that a disaster has occurred for which affected local governments are unable to respond adequately. Therefore, pursuant to the authority vested in me by the Constitution, the laws of the State of New York and section 28 of article 2-B of the Executive Law, I hereby declare a disaster emergency, effective February 23, 1985, within the territorial boundaries of Cattaraugus, Chautauqua, Erie, Genesee, Niagara, Orleans Counties and contiguous areas;
FURTHER, pursuant to section 29 of article 2-B of the State Executive Law, I direct the implementation of the State Disaster Preparedness Plan and authorize, effective February 23, 1985, the State Emergency Management Office, the State Department of Transportation, and other State agencies as necessary, to take appropriate action to assist those affected counties in restoring vital public transportation systems and to provide such other assistance as may be necessary to protect the public health and safety.
