WHEREAS, the proper management of hazardous waste has long been of serious concern to the people and government of New York State; and
WHEREAS, central to his concern is the provision, where necessary, of adequate, technologically advanced, treatment facilities to manage the hazardous waste generated within the State; and
WHEREAS, it is desirable to bring together the concerns of government, industry and the citizens of New York regarding hazardous waste treatment and disposal needs so that a rational and viable State policy and process for hazardous waste management facility siting can be established.
NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the New York State Hazardous Waste Treatment Facilities Task Force.
I. Membership
The task force shall consist of the Commissioner of Environmental Conservation; the Commissioner of Health; the Commissioner of Transportation; the Commissioner of Commerce; and eight persons to represent independent environmental groups, the affected industries and other interested parties and to be appointed by the Governor. In addition, the President pro tem of the Senate, the Speaker of the Assembly, the Minority Leader of the Senate and the Minority Leader of the Assembly may each appoint one person to the task force. The Commissioner of Environmental Conservation shall serve as the chairman. The members of the task force shall receive no compensation, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.
II. Powers and Responsibilities of Task Force
The task force shall examine information regarding hazardous waste treatment facilities in the State and shall recommend to the Governor and the Legislature a State policy and process for developing any needed treatment capacity in accordance with the three-phase program described in section III below. IV. Cooperation of State Agencies
All departments, divisions, boards, offices and public corporations shall cooperate with and provide such assistance as may be required for the task force to fulfill its purposes.
