WHEREAS, the proper management of hazardous waste has long been of serious concern to the people and government of New York State; and

WHEREAS, central to his concern is the provision, where necessary, of adequate, technologically advanced, treatment facilities to manage the hazardous waste generated within the State; and

WHEREAS, it is desirable to bring together the concerns of government, industry and the citizens of New York regarding hazardous waste treatment and disposal needs so that a rational and viable State policy and process for hazardous waste management facility siting can be established.

NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the New York State Hazardous Waste Treatment Facilities Task Force.

I. Membership

The task force shall consist of the Commissioner of Environmental Conservation; the Commissioner of Health; the Commissioner of Transportation; the Commissioner of Commerce; and eight persons to represent independent environmental groups, the affected industries and other interested parties and to be appointed by the Governor. In addition, the President pro tem of the Senate, the Speaker of the Assembly, the Minority Leader of the Senate and the Minority Leader of the Assembly may each appoint one person to the task force. The Commissioner of Environmental Conservation shall serve as the chairman. The members of the task force shall receive no compensation, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.

II. Powers and Responsibilities of Task Force

The task force shall examine information regarding hazardous waste treatment facilities in the State and shall recommend to the Governor and the Legislature a State policy and process for developing any needed treatment capacity in accordance with the three-phase program described in section III below. The task force shall:

A. Determine if adequate, technologically advanced, hazardous waste treatment and disposal facilities are available and if additional such facilities are needed to meet the short- and long-term needs of New York State industries.

B. Evaluate different treatment and disposal technologies, including incineration, for various classes of wastes.

C. Specify options for the treatment and disposal of hazardous waste and identify the strengths and weaknesses of each option.

D. Identify and evaluate appropriate criteria for siting hazardous waste treatment and disposal facilities.

E. Evaluate the respective roles of the public and private sectors in implementing any recommendations.

III. Description of Three-Phase Program

A. Phase 1--Task Force Review of Options. The task force shall examine hazardous waste treatment and siting strategies and describe the strengths and weaknesses of each option. A report on Phase 1 shall be presented by December 1, 1983.

B. Phase 2--Public Hearings. Public hearings shall be conducted to obtain public views on the Phase 1 report of the task force as well as on other suggested solutions of the State's hazardous waste treatment and siting problems.

C. Phase 3--Final Report to Governor. The task force shall submit by March 1, 1984 its final report following evaluation of the public hearing record. This report shall recommend a State program for hazardous waste treatment and disposal facilities.

IV. Cooperation of State Agencies

All departments, divisions, boards, offices and public corporations shall cooperate with and provide such assistance as may be required for the task force to fulfill its purposes.
