Section 4.178 - Executive order no. 178: establishing the temporary task force on health insurance for retired educational employees

WHEREAS, the costs of health care coverage have risen sharply throughout the nation in recent years;

WHEREAS, continued health insurance benefits for retirees of educational institutions has long been of serious concern to the people and government of New York State;

WHEREAS, the national recession and subsequent sluggish economic recovery have forced nearly all levels of government to take actions to reduce or control expenditures;

WHEREAS, a number of school districts have opted out of the State Health Insurance Plan in order to obtain less expensive health insurance coverage through private insurance carriers;

WHEREAS, retirees increasingly face severe threats to their financial security due to their former employers' cutbacks on the provision of health insurance; and

WHEREAS, it is desirable to bring together the concerns of local school districts, retirees of educational units and the citizens of New York regarding the funding of continued health insurance coverage for retired educational employees;

NOW, THEREFORE, I, MARIO M. CUOMO, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby order as follows:

I. Temporary Task Force on Health Insurance for Retired Educational Employees

There is hereby created the Temporary Task Force on Health Insurance for Retired Educational Employees. The Task Force shall consist of five members appointed by the Governor, one of whom shall be appointed on the recommendation of the Temporary President of the Senate and one of whom shall be appointed on the recommendation of the Speaker of the Assembly. The Governor will select the Chair from among the five members. Members of the Task Force shall receive no compensation but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.

II. Powers and Responsibilities of the Task Force

The Task Force shall examine issues relating to continued health insurance coverage for retirees of local educational units, including the merits and potential costs of providing such coverage.

The Task Force shall make recommendations to the Governor and the Legislature by May 31, 1994 on a policy and process for ensuring that retiree benefits are treated equitably.

III. Cooperation of State Agencies

All departments, divisions, boards, offices and public corporations shall cooperate with and provide such assistance as may be required for the Task Force to fulfill its obligations.

WHEREAS, the Temporary Task Force on Health Insurance for Retired Educational Employees was established by Executive Order Number 178 on December 17, 1993 to examine issues relating to continued health insurance coverage for retirees of local educational units, including the merits and potential costs of providing such coverage;

WHEREAS, Executive Order Number 178 required the Temporary Task Force to issue recommendations to the Governor and the Legislature by May 31, 1994 on a policy and process for ensuring that retiree benefits are treated equitably;

WHEREAS, the Temporary Task Force has issued interim recommendations on this matter, has provided good cause as to why completion of the study and analysis will require additional time, and has requested an extension in the deadline for the filing of its final findings and recommendations; and

WHEREAS, it is in the best interest of the State that the findings and recommendations of the Temporary Task Force be thorough and complete;

NOW, THEREFORE, I, MARIO M. CUOMO, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby continue Executive Order Number 178 dated December 17, 1993, except that the second paragraph of Section II of such

Executive Order is amended to read as follows:

The Task Force shall make recommendations to the Governor and the Legislature by December 1, 1994 on a policy and process for ensuring that retiree benefits are treated equitably.
