Section 4.119 - Executive order no. 119: reconstituting the job training partnership committee

WHEREAS, the strength and vitality of the economy of New York State depend on the quality of our human resources;
WHEREAS, the productivity of our workforce will increase as a result of enhanced training and educational activities;
WHEREAS, targeted programs of education and training provide effective means for expanding economic opportunities for unemployed and underemployed New Yorkers;
WHEREAS, the Federal Job Training Partnership Act (JTPA) of 1982 (as amended), the Federal Omnibus Trade and Competitiveness Act of 1988 and other State and Federal legislation have given State government responsibility for planning, coordination and oversight of employment, training and related programs consistent with the State's overall economic development strategy;
WHEREAS, the Job Training Partnership Committee was established by Executive Order to assist in the development, implementation and analysis of the State's employment and training programs;
WHEREAS, this committee has had success in meeting these objectives by bringing together representatives of business, labor and government to address cooperatively the needs of the State workforce; and
WHEREAS, recent legislation, including the State Work Force Preparation Evaluation Act and the Federal Omnibus Trade and Competitiveness Preparation Evaluation Act and the Federal Omnibus Trade and Competitiveness Act of 1988, imposes new duties and responsibilities on this committee and requires a reorganization of its structure;
NOW, THEREFORE, I, MARIO M. CUOMO, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby reconstitute the Job Training Partnership Committee, henceforth to be known as the Job Training Partnership Council (the "Council"), and do appoint the Lieutenant Governor to serve as vice chair of the Council, and charge the Council with the responsibility for expanding the opportunities available to New Yorkers to obtain the information, knowledge and skills necessary to participate fully in a growing, vibrant economy.
I. Membership
The Council shall consist of 50 members appointed by the Governor, constituted as follows:
The Governor shall designate a chairperson who shall not be a representative of State or local government.
Members of the Council shall receive no compensation, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.
II. Terms of Office
Upon reconstitution of the Job Training Partnership Council, members, excluding those specifically designated permanent members, shall be appointed for the following terms: one-third shall be appointed for one year; one-third shall be appointed for two years; and one-third shall be appointed for three years. Thereafter, the terms of members reappointed shall be three years. Any member appointed to fill a vacancy shall serve the balance of the term that was vacated.
III. Powers and Duties
The Council shall advise the Governor on matters relating to the planning and administration of job training and placement programs, including but not limited to those funded through the Job Training Partnership Act (as amended) and the Omnibus Trade and Competitiveness Act of 1988. Specifically, the Council shall undertake to:
IV. Responsibilities of State Agencies
All agencies, departments, divisions, boards, offices and public corporations of the State are directed to cooperate with, and provide necessary assistance to, the Council. Such assistance may include, but need not be limited to, consultation with and the use of agency staff and the provision of all necessary statistical and policy data.
V. Revocation of Prior Executive Order and Effective Date
Executive Order 10 dated March 17, 1983 is hereby revoked and superceded by this Executive Order, which shall take effect immediately. Signed: Mario M. Cuomo Dated: January 6, 1989
