Section 3.88 - Executive Order No. 88: Establishing guidelines for the operation of the Community Advisory Committee

I, Hugh L. Carey, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, in order to ensure community participation during the planning stages of the New York City Convention Center development by the Community Advisory Committee established pursuant to the act suthorizing such convention center development, do hereby establish the following guidelines for the operation of said Community Advisory Committee.
(1) The Development Corporation will submit to the Community Advisory Committee, at such time as the draft environmental impact statement is available, or at such time prior thereto as the Development Corporation deems appropriate: site survey, proposed general site plan showing the location and use of the buildings and other structures and pedestrian and vehicular entrances and exits, schematic drawings of the design of the Convention Center indicating the arrangement and use of space, draft environmental impact statement, traffic circulation plan, and proposals for other construction at the site of the Convention Center and in the general vicinity thereof.
(2) The Community Advisory Committee may, if and to the extent it deems appropriate, conduct a public hearing and prepare and submit written recommendations with respect to such materials to the Development Corporation. If any such recommendations are received within 60 days after the submission by the Development Corporation to the Community Advisory Committee and are not adopted, the Development Corporation shall not proceed with the actions which shall be the subject of such recommendations until the Development Corporation has communicated in writing its determination and the reasons therefor to the Community Advisory Committee, which determinations shall be final and shall not be subject to review.
(3) If, at any time subsequent to the submission of materials to the Community Advisory Committee, there is a substantial alteration or amendment in the contents of the materials theretofore submitted, the Development Corporation shall submit to the Community Advisory Committee information with respect to the proposed alteration or amendment. Any determination by the Development Corporation that any such alteration or amendment is not substantial in nature shall be final and shall not be subject to review. The Community Advisory Committee may, if and to the extent it deems appropriate, conduct a public hearing and submit recommendations with respect to the proposed alteration or amendment in accordance with the procedure set forth above, but within 30 days of such submission.
